It is the policy of Futurist Feed to promptly respond to proper notices of alleged copyright infringement in accordance with the United States Digital Millennium Copyright Act (DMCA), a copy of which can be found at the U.S. Copyright Office Website (http://www.copyright.gov).

We expect all users of Futurist Feed to comply with applicable copyright laws. However, if we receive a proper notification of claimed copyright infringement, our response will include removing or disabling access to the material claimed to be infringing and terminating contributors, irrespective of our liability under United States law or the laws of another jurisdiction.

In the event that we remove or disable access in response to such a notice, we will make a good-faith effort to contact the creator of the affected content to allow them to submit a counter-notification in accordance with Sections 512(g)(2) and (3) of the DMCA. We may also maintain records of alleged infringements on which we have taken action.

Infringement Notification: Filing a DMCA Notice of Copyright Infringement

Upon receipt of a proper notification of claimed infringement, Futurist Feed will adhere to the following procedures as outlined in the DMCA.

To file a notice of infringement with Futurist Feed, you must provide written communication (via email, fax, or mail) that includes the information detailed below.

Please note that you may be held liable for damages, including costs and attorney’s fees, if you materially misrepresent that material is infringing your copyright(s). Therefore, if you are unsure about your copyright ownership or the protection of your material, it is advisable to seek legal counsel.

To expedite the processing of your request, please use the following format (including section numbers):

  1. **Your contact information, including your name, address, telephone number, and an email address where you can be contacted as the complaining party.
  2. The statement: “I am the copyright owner or an agent authorized to act on the owner’s behalf of the following copyrighted material:”
  3. Identification of the copyrighted content you believe has been infringed with sufficient detail (e.g., “The copyrighted image in question is the ‘Content Title’ described as ‘Description: literary work, image, etc.’ by ‘name of the author,’ including any federal registration information if available).
  4. Identification of the material claimed to be infringing or the subject of infringing activity and information reasonably sufficient for Futurist Feed to locate the material (e.g., “Title of Article” at this location: https://futuristfeed.com/link-to-article/).
  5. The statement: “I have a good faith belief that the use of the material above in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  6. The statement: “I swear, under penalty of perjury, that the information in the notification is accurate.”
  7. Sign the document.

Counter Notification

The provider of the allegedly infringing content may submit a counter-notification under Sections 512(g)(2) and (3) of the Digital Millennium Copyright Act.

To file a counter-notification with us, you must provide written communication (via regular mail) that includes the information specified below. Please note that emailing this information is subject to prior written agreement. You may be held liable for damages, including costs and attorneys’ fees, if you materially misrepresent that a product or activity does not infringe the copyrights of others. Therefore, if you are uncertain about whether particular material infringes the copyrights of others, we recommend that you first consult an attorney.

To expedite the processing of your request, please use the following format (including section numbers):

  1. Identification of the material that has been removed or to which access has been disabled and the location where the material appeared before its removal or disabling.
  2. Your name, address, telephone number, and an email address where you can be contacted.
  3. The statement: “I consent to the jurisdiction of the Federal District Court for [insert the federal judicial district in which your address is located].”
  4. The statement: “I will accept service of process from [insert the name of the person who submitted the infringement notification] or their agent.”
  5. The statement: “I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled due to a mistake or misidentification of the material to be removed or disabled.”
  6. Sign the document.
